Terms & Conditions

1. Introduction
Element Payment Solutions (Private) Limited ("EPS") provides payment gateway services as an intermediary between merchants and partner banks. EPS does not handle or hold funds; all settlements, disputes, and chargebacks are managed directly by the partner bank.
2. Scope of Services
EPS will:
  • Enable merchants to accept payments through the partner bank’s system.
  • Provide system credentials and API access.
  • Support integration and technical requirements.
  • Merchants may begin using services only after successful KYC completion and partner bank approval.
3. Fees & Payment
Service fees are calculated on the transaction amount as outlined in Schedule 1.
All fees are paid directly to the partner bank.
EPS does not process or settle payments.
4. Merchant Responsibilities
Merchants must:
  • Provide accurate KYC details and comply with all applicable laws and regulations.
  • Keep access credentials secure.
  • Avoid prohibited or illegal transactions.
  • Cooperate in resolving chargebacks or disputes with the partner bank.
5. EPS Responsibilities
EPS will:
  • Maintain a secure and operational payment gateway.
  • Protect merchant data and ensure compliance with applicable data protection laws.
  • Share required documents with the partner bank for KYC purposes.
6. Shipping Policy
EPS is not responsible for shipping, delivery, or logistics. These are handled entirely by the respective merchant.
7. Refund Policy
All refunds are processed by the merchant in line with their own policies. EPS is not involved in issuing refunds.
8. Return Policy
All returns are managed by the merchant according to their own policy. EPS is not involved in processing returns.
9. Taxes
Merchants are responsible for all taxes related to their business and transactions.
EPS is responsible only for taxes applicable to its own operations.
10. Termination
EPS may suspend or discontinue services in case of non-compliance, legal violations, or breach of terms. Merchants must stop using EPS services immediately upon termination and delete all EPS confidential information.
11. Miscellaneous
Amendments: Any updates will be published on the EPS website.
Force Majeure: EPS is not liable for delays beyond its control.
Dispute Resolution: All disputes will be handled under Pakistani law through arbitration.
Governing Law: Pakistan law applies.
